Online Gambling Ads Under Global Scrutiny: Regulatory Crackdowns Intensify



The online gambling industry has experienced a notable increase in regulatory scrutiny regarding advertising practices in recent years. As digital platforms become the primary channels for gambling promotions, governments worldwide are implementing stricter regulations to protect consumers, particularly vulnerable groups, and ensure responsible marketing.

In 2024, global gambling fines increased by 12.1%, totaling $85.3 million, with Australia accounting for more than half of these penalties. This increase underscores the growing emphasis on compliance and responsible gambling practices. Australian regulators, in particular, have been vigilant in enforcing advertising standards, resulting in substantial fines for operators that fail to adhere to regulations.

One notable case involved Tabcorp, Australia's largest gambling company, which was fined A$4.3 million for breaching harm minimization laws. The violations included sending direct marketing materials to a customer who had opted out and inadequate employee training to mitigate gambling harm. This case highlights the importance of adhering to consumer protection laws and the consequences of non-compliance.

In the United Kingdom, the Information Commissioner's Office reprimanded Sky Betting & Gaming for unlawfully sharing users' personal data with advertising companies. Although the company acknowledged the error and rectified it promptly, the incident highlights the importance of operators ensuring data privacy and compliance with advertising regulations.

Similarly, in the United States, an audit revealed that sports betting companies in Massachusetts targeted minors and individuals with gambling addictions with advertisements. Between March 2023 and March 2024, the Massachusetts Gaming Commission received 51 complaints related to such advertising practices. In response, the commission is collaborating with an independent auditor to ensure that each license holder complies with advertising regulations.

These cases illustrate the global trend of tightening regulations around online gambling advertising. Governments are increasingly focusing on protecting consumers from aggressive marketing tactics that may lead to gambling-related harm. The emphasis is on ensuring that advertising is responsible, transparent, and does not target vulnerable populations.

In response to these regulatory pressures, digital platforms are also taking steps to limit the availability of content related to gambling. For instance, Meta has been instructed by Brazilian authorities to remove illegal gambling ads within 48 hours, demonstrating the government's willingness to impose immediate compliance deadlines. The platform has also removed Facebook pages of influencers tied to illegal gambling, expanding enforcement beyond traditional advertising accounts.

Similarly, TikTok has implemented comprehensive restrictions on gambling advertising across multiple markets. The platform's branded content policy now prohibits most forms of gambling promotion, including online casinos, sports betting, fantasy games, and lottery services. These restrictions have particularly impacted companies targeting younger demographics, who are more active on social media platforms.

The global regulatory landscape is evolving, with governments and digital platforms working together to ensure that online gambling advertising is conducted responsibly. Operators are being held accountable for their marketing practices, and non-compliance can lead to significant financial penalties and reputational damage.

As the industry continues to grow, gambling operators need to stay informed about regulatory changes and implement robust compliance measures. This includes ensuring that advertising materials are transparent, not misleading, and do not target vulnerable individuals. By doing so, operators can contribute to a safer gambling environment and maintain consumer trust.
